Privacy Policy - Canada

By sharing the Privacy Policy for Crate and Barrel Canada, Inc. (collectively, "we," “our” or "us"), we hope to help you understand how information can create new opportunities for our customers, as well as to reassure you that we respect and honour customer requests to restrict and protect Personal Information.

We have adopted a series of Privacy Policies in order to address the specific privacy concerns of certain groupings of individuals.

This Privacy Policy applies to the Personal Information of all individuals (other than employees) who interact with us in Canada, including the Personal Information that we collect from or about you when you visit or use crateandbarrel.ca, cb2.ca or our mobile apps displaying this Privacy Policy (collectively, "Websites"), or when you call or come into our stores in Canada or call customer service from Canada. Where an individual seeks to be, is or was employed by us in Canada, their Personal Information is dealt with in our "Employee Privacy Policy - Canada".

It is our policy to comply with the privacy legislation within each jurisdiction in which we operate. Sometimes the privacy legislation and / or an individual's right to privacy are different from one jurisdiction to another. This Privacy Policy covers only those activities that are subject to the provisions of Canada's federal and provincial privacy laws, as applicable. Information We Collect

What is Personal Information?

"Personal Information" means any information about an identified individual or an individual whose identity may be inferred or determined from that information. Personal Information does not include business title or business contact information when used or disclosed for the purpose of business communications, or aggregated or anonymous data from which the identity of an individual cannot be determined. We retain the right to use aggregated and anonymous data in any way that we determine is appropriate.

What Personal Information do we collect?

We collect and maintain different types of Personal Information in respect of the individuals (such as our customers and vendors) with whom we interact. This includes:

  • contact and identification information, such as your name, address, telephone number and e-mail address;
  • product and service related information concerning the products and services that we provide to, or receive from, you; and
  • business relationship information, including information related to your agreements, preferences, advisors and decision-makers, feed-back and information requested by or provided to you.

When you make a purchase in one of our stores, on our Websites or otherwise, create an account, join our Gift Registry (in-store or via app), participate in a sweepstakes or contest or any other promotion, post a product review, answer one of our surveys, or interact with us in any way, you may choose to give us Personal Information. We may also collect information about your interactions with us, such as the items you have purchased or the contest or sweepstakes you have entered.

This allows us to provide you with our services, to process your transactions more efficiently and, ultimately, to give you a higher caliber of customer service. If you choose not to provide the requested information we may not be able to provide you with the services, or certain features of those services may not be functional.

When you apply for a job:

Our Site includes a Careers feature that allows you to submit an online job application if you reside in the US or Canada. When you submit an online application, you will be required to provide personal information, including but not limited to your name, contact information and job history. This information will be used by us to assess and process your application. You will be provided with more information about how we process this information as part of the application process.

You will also be asked to provide equal opportunities information. This is not mandatory – if you don’t provide it, it won’t affect your application. We won’t make the information available to any staff outside our recruitment team, including hiring managers and any relevant support staff, in a way that can identify you. Any information you provide will be used to produce and monitor equal opportunities statistics.

The online application process is hosted and supported by a third-party service provider, iCIMS. iCIMS receives and stores the information you provide. iCIMS does not disclose the personal information it receives and maintains for us to anyone else. Click here to see the iCIMS privacy policy.

If we decide to interview you, we may use your application during the interview process and we may ask you to provide additional information during the interview or hiring process. We may also use the information you provide to contact you about your application, such as to ask you to agree to a background check or to send you an offer letter.

We do not share the information you provide in the online application to anyone outside of the Company and iCIMS, except as we believe is required by law.

Usage and Website Activity Information:

When you visit our websites, we or our third party service providers collect information about your use of the website: your Internet service provider's address, your location as determined by your Internet Protocol (IP) address, the name of the Website or advertisement directing you, your user agent, as well as your clicks and activity on our Websites. We use this information to understand how to make our Websites more available and user-friendly to our customers as well as to provide you with advertising that may be of interest to you. We do not serve interest-based advertising to users we identify as using our websites from EU IP addresses.

Google and Adobe Analytics:

We use tools called “Google Analytics” and “Adobe Analytics” to collect some information we listed above about your use of the services. We use the information we get from Google Analytics and Adobe Analytics to improve our Websites. In order to collect this information, Google Analytics and Adobe Analytics may set cookies on your browser or mobile device, or read cookies that are already there. Google Analytics and Adobe Analytics may also receive information about you from apps you have downloaded that partner with Google or Adobe, respectively.

Google’s ability to use and share information collected by Google Analytics about your visits to our Websites to other applications which partner with Google, is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Adobe’s ability to use and share information collected by Adobe Analytics about your visits to our Websites to other applications which partner with Adobe, is restricted by the Adobe Analytics Terms of Use and the Adobe Privacy Policy. The Google Analytics and Adobe Analytics products we use collect only anonymized IP addresses for IP’s located in the European Union.

In-Store Information:

In some of our Canadian store locations, we may collect location analytics (for example, if you choose to use our Guest Wi-Fi). This data is used to improve store layout and enhance customer shopping experience in our stores. Certain device information, like device ID and location, is collected. Additional Personal Information is only collected if you consent to that collection.

We may use cameras in our stores to assist with safety, security and loss prevention. We also use cameras to track store traffic, though this use does not personally identify shoppers. This is not meant to suggest that you will in fact be monitored or be subject to surveillance. It is meant to bring to your attention that such monitoring may occur and may result in the collection of Personal Information from you.

We may engage with you on various social media platforms like Facebook, Twitter, Pinterest and Instagram. If you contact us on one of these platforms for customer service or otherwise, we may contact you via direct message. Those communications are governed by this Policy as well as the policy of the relevant social media platform. Cookies and Other Tracking Technologies

"Cookies" are small amounts of data that are stored on your computer. They find their way to your browser via a web server. Cookies flag information about your activity on our Websites. This information helps us improve our Websites and make them friendlier and easier to use and allows us to market to you more effectively. How We Use Your Information

The Personal Information we collect is primarily used to provide you with our products and services, to process your transactions, to communicate with you, to offer better customer service and to improve communications.

When a purchased item is not immediately available, many of our customers appreciate receiving an email to update the status of their order. We also may need to contact customers by phone, postal mail or email if questions arise regarding their orders.

We also use Personal Information to send you information about products, services, and promotions that we think will be of interest to you if you have requested this information.

When you shop at our stores or order from our digital catalogs in Canada it is also an opportunity for you to provide us with information and feedback that helps us continue to bring new ideas, unique products and a creative approach to shopping for your home.

When you are supplying products and services to us, we may collect Personal Information to establish, maintain and manage our relationship with you, so that we may receive from you the products and services that have been requested, review such products and services, and work with you and so that you may understand our requirements for such products and services;

We also collect Personal Information to enable us to comply with applicable law or regulatory requirements, to protect us against error, fraud, theft and damage to our goods and property, and any other reasonable purpose to which you consent.

Third-Party Service Providers

In order to serve you better, we may at times contract with other companies (“Service Providers”) to help us process information and provide other services to us. For instance, their assistance can help us fulfill customer orders, manage, store and enhance customer data, send marketing, run promotions, and provide other services. For your security, these companies are bound by our nondisclosure agreements or other contractual arrangements to provide privacy protection for your information. Some of our Service Providers are located outside of Canada, including in the United States and India.

Advertising and Online Tracking

We contract with Service Providers to place our banner advertising on other websites. These Service Providers may collect information from us about your visits to our Websites and stores, and your interaction with our products and services. They also may use this information to tailor banner advertisements for goods and services. This information is collected through the use of a pixel tag (a small block of code on a webpage that allows the website to do things like read and place cookies), which is technology used by major websites. Personal Information may be shared with our Service Provider and its service providers, including, without limitation, your name, postal address and email address, as well as a record of any transactions you conduct on our Website or offline in order to deliver banner advertisements and other advertising tailored to your interests when you visit certain websites. We may track this information across the different devices you use to access the Websites. Our trusted Service Provider will not share any Personal Information with any other third parties, except as required to provide this service or as provided in this Policy.

Information Sharing

We may share information with third parties as necessary to detect and prevent fraud and other unlawful activities. We review transactions internally on a regular basis to identify potential concerns, and we partner with select Service Providers to further enhance our ability to ensure that fraudulent orders and/or potentially damaging worms, viruses and other types of malware do not interfere with our ability to provide the best possible products, value and services to you and to our other valued customers.

Where Information Can Be Shared or Disclosed without Consent: There may be exceptional circumstances where the use and/or disclosure of Personal Information may be justified or permitted or where we are obliged to disclose information without your consent. Such circumstances may include:

  • Where required by law or by order or requirement of a court, administrative agency or governmental tribunal;
  • Where we believe, upon reasonable grounds, that it is necessary to protect the rights, privacy, safety or property of an identifiable person or group;
  • Where it is necessary to permit us to pursue available remedies or limit any damages that we may sustain; or
  • Where it is reasonable for the purposes of investigating a breach of an agreement, or actual or suspected illegal activity.

In addition, Personal Information may be disclosed or transferred to another party during the course of, or completion of, a change in ownership of, or the grant of a security interest in, all or a part of our business through, for example, an asset or share sale, or some other form of business combination, merger or joint venture, provided that such party is bound by appropriate agreements or obligations, and required to use or disclose your Personal Information in a manner consistent with the use and disclosure provisions of this Privacy Policy, unless you consent otherwise.

Your Information Sharing Choices

We appreciate and respect that not all customers may wish to benefit from the opportunity to share information with other select companies. It is important to understand that with some companies or online partners, your information must be shared in order to receive their services.

For instance, when you order a large furniture item, we may send your name, address, email address and phone number to our shipping and in-home delivery vendors, allowing you to access their online delivery scheduling system. Our vendor does not share your Personal Information with third parties; it is used strictly to coordinate and complete your shipment and as described in this Privacy Policy.

Opting out of sharing your information for marketing purposes will not prevent your relevant information from being provided to shippers when you order products for delivery or from other sharing for non-marketing purposes. Similarly, this will not prevent us from sharing information as and to the extent it is combined or aggregated (in a non-personally identified manner) or otherwise analyzed by us or our Service Providers.

In some circumstances we may not agree with your request to change your Personal Information and will instead append an alternative text to the record in question.

Remove Your Name From Our Lists at Any Time

To delete your name from our electronic contact lists (email or text), please follow these simple opt-out instructions. You can also follow the opt out instructions included with many texts and emails sent by us. Please note that, to provide you with more control of your experience with us, opting out of one brand does not automatically opt you out of our other brands. For example, if you choose to opt out of electronic communications from Crate and Barrel, you will not be opted out of electronic communications from CB2; if you wish to opt out of either or both of those brands, you must visit each of their respective opt out pages and follow the opt out instructions.

When you make subsequent purchases at Crate and Barrel or CB2 you may provide contact information for customer service only, and request that your name not be forwarded to either mailing list. If you have already opted out, you do not need to opt out again; your information will not be used for purposes other than the customer service you have requested, unless you affirmatively ask to opt in again, in which case you will be opted in and will receive electronic communications from us until you again request to be opted out again.

In addition, the Personal Information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices.

In the event that we cannot provide you with access to your Personal Information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.

We adhere to a strict privacy code regarding children and do not knowingly accept Personal Information from any child under the age of 16. If it is brought to our attention that we have inadvertently received Personal Information from a child under 16, we will promptly remove such Personal Information from our records.
